The man who was wrongly accused of throwing a beer on a player at FirstEnergy Stadium is taking the Cleveland Browns to court.
Eric Smith filed a defamation lawsuit against the team this week.
The Browns initially banned Smith from future games, claiming he poured beer on an opposing team's player last month.
However, they later backtracked after media reports uncovered the mistaken identity.
