DELAWARE, Ohio (WTVN) -- A judge has acquitted former Ohio State football player James Stillwagon on charges stemming from a road rage incident last year.

A grand jury had indicted Stillwagon on charges of felonious assault after a man claimed Stillwagon had fired several shots at him in a parking lot near U.S. 23 and Williams Street in Delaware. 

Friday, Judge Duncan Whitney ruled that there wasn't enough evidence to that Stillwagon did anything wrong.

"We strongly disagree with the decision of Judge Whitney," said Delaware County Prosecutor Carol O'Brien. "As a result, Mr. Stillwagon's conduct will not be judged by a jury of his peers."
